Claim for Default Interest by RES Producers – Case Referred to the Plenary Session of the Supreme Civil and Criminal Court of Greece
By its decision no. 378/2025, the Third Civil Chamber (A3) of the Supreme Civil and Criminal Court of Greece (Areios Pagos) ruled by majority that the Renewable Energy Sources Operator & Guarantees of Origin S.A. (DAPEEP S.A.) is obliged to pay default interest to producers of Renewable Energy Sources (RES) due to prolonged delays in the settlement of their invoices.
Given the seriousness and broader legal significance of the issue, the case has been referred to the Plenary Session of the Supreme Court for a final judgment.
This development confirms the legal initiative undertaken by our law firm, MStR Law, several years ago to address the matter of default interest owed to RES producers.
The legal community and RES producers alike are now closely awaiting the Supreme Court’s plenary decision with great interest.
